Terms and Conditions for Regulate™

These Terms and Conditions (“Terms”) govern your purchase of and access to Regulate™ (“Regulate™,” “the Program,” “the Product,” or “the Content”), a self-guided digital education product sold by Studio AZK LLC (“Company,” “we,” “us,” or “our”).

By purchasing, accessing, or using Regulate™, you agree to these Terms. If you do not agree to these Terms, do not purchase or access the Product.

Description of Product and Relationship

Regulate™ is a self-guided digital product hosted through Kajabi. It includes pre-recorded videos, pre-recorded audio practices, educational content, and other related digital materials.

The Product is provided for general educational and self-guided wellness purposes only. Although it is created by a licensed psychologist, it is not psychotherapy, psychological treatment, medical care, mental health care, crisis support, or a substitute for individualized care from a licensed health or mental health professional.

The Product does not include live sessions, psychotherapy, coaching, individualized feedback, individualized treatment recommendations, crisis support, clinical monitoring, a private community, or ongoing clinical support from Anahita Kalianivala or Studio AZK LLC.

Regulate™ is a self-guided educational product. Purchasing or using it does not, by itself, establish an individualized coaching, consulting, or other professional services relationship with Anahita Kalianivala.

Your purchase or use of the Product does not constitute assessment, diagnosis, treatment planning, clinical monitoring, individualized medical advice, individualized mental health advice, or any other professional healthcare service. No duty to assess, diagnose, treat, monitor, intervene, follow up, or provide crisis support is created by your purchase or use of the Product.

Limits of Service

Regulate™ is not intended to diagnose, treat, cure, or prevent any medical condition, mental health condition, chronic pain condition, trauma-related condition, or other health concern.

If you have medical, psychological, psychiatric, or safety concerns, you should consult your own licensed healthcare or mental health provider.

The Product is not appropriate for emergencies or crises. If you are in immediate danger, may harm yourself or someone else, or need urgent support, call emergency services or contact an appropriate crisis resource in your location.

Do not use the Product as a substitute for medical advice, psychological care, therapy, crisis services, medication management, or other individualized professional support.

User Responsibility and Safety

Regulate™ is intended for adults age 18 and older.

By purchasing or accessing the Product, you represent that you are at least 18 years old and legally able to enter into this agreement.

You are responsible for deciding whether and how to use the practices included in Regulate™.

Please engage with the practices only in an environment that feels reasonably safe, private, and appropriate for relaxation or self-reflection. Do not listen to or participate in audio or video practices while driving, operating machinery, caring for others in a way that requires active attention, or doing anything where becoming relaxed, inwardly focused, emotionally activated, distracted, or drowsy could create a safety risk.

You are encouraged to pause, modify, or stop any practice at any time. You should not continue any practice that feels overwhelming, unsafe, destabilizing, physically uncomfortable, emotionally unmanageable, or otherwise inappropriate for you.

By using the Product, you acknowledge that self-guided practices may bring up sensations, emotions, thoughts, memories, or body awareness. You agree to use your own judgment, seek appropriate support when needed, and consult your own healthcare or mental health providers regarding your individual circumstances.

Intended Outcomes

Regulate™ is intended to provide education and self-guided practices. We do not guarantee any particular outcome, result, symptom change, emotional state, health improvement, pain reduction, nervous system change, or personal transformation.

Testimonials, examples, or descriptions of possible benefits are illustrative only and do not guarantee that you will have the same or similar experience.

Platform Access

Regulate™ is hosted on Kajabi or a related digital platform. You may be required to create or use a Kajabi account to access the Product.

You are responsible for maintaining access to the email address and login credentials associated with your purchase. You are also responsible for having the internet connection, device, software, browser, and other technology needed to access the Product.

We are not responsible for limitations, interruptions, outages, compatibility issues, or changes caused by Kajabi, your device, your internet provider, your email provider, or other third-party platforms or services.

Definition of Lifetime Access

Regulate™ is described as including “lifetime access,” which means access for the lifetime of the Product and/or the platform on which it is hosted. It does not mean your lifetime, the lifetime of Studio AZK LLC, or indefinite access under all circumstances.

We reserve the right to update, modify, move, replace, discontinue, or retire Regulate™ or the platform used to host it.

If Regulate™ is discontinued, substantially changed, or moved to a different platform, Studio AZK LLC will make reasonable efforts to provide advance notice and/or continued access instructions when feasible. However, we cannot guarantee indefinite access to the Product or any specific platform.

Payment Terms

Regulate™ is offered as a one-time purchase. There are no recurring charges. You agree to provide accurate payment information and authorize the stated charge at checkout.

Because Regulate™ is a digital product with immediate access to the Content after purchase, all sales are final and non-refundable, except as expressly provided below or required by law.

By purchasing the Product, you acknowledge and agree that you are receiving access to digital content that cannot be returned, and that no refunds will be provided for change of mind, lack of use, misunderstanding of the Product’s purpose, or dissatisfaction with the Product.

If you experience an access issue, you may contact hello@studioazk.com so we can attempt to resolve it. If we are unable to provide the purchased access after reasonable efforts, we will refund the purchase price.

You agree not to initiate a chargeback or payment dispute for an authorized purchase that was delivered as described. If you have a billing or access concern, please contact us first at hello@studioazk.com so we can attempt to address the concern.

Nothing in these Terms is intended to limit any non-waivable consumer rights that may apply under applicable law.

License and Permitted Use

Your purchase gives you a limited, non-exclusive, non-transferable license to access and use Regulate™ for your own personal, individual, non-commercial use. We may suspend or terminate this license if you materially violate these Terms, including by sharing access or distributing the Content without permission.

You may not share your login credentials, provide access to another person, copy the Content, download the Content unless expressly permitted, reproduce the Content, distribute the Content, teach from the Content, adapt the Content, sell the Content, resell the Content, upload the Content to another platform, or use the Content in your own professional, commercial, clinical, coaching, educational, or group setting without prior written permission from Studio AZK LLC.

Regulate™ is not intended for shared, household, organizational, professional, group, or institutional use.

Intellectual Property

All content included in Regulate™, including but not limited to videos, audio recordings, written materials, titles, text, images, designs, concepts, frameworks, and related materials, is owned by Studio AZK LLC or used with permission.

Nothing in your purchase transfers ownership of the Content to you.

Unauthorized copying, sharing, distribution, reproduction, resale, teaching, public display, or derivative use of the Content is prohibited.

Privacy

Your purchase and access to Regulate™ may involve the collection and processing of information such as your name, email address, payment information, account access information, and product usage/access data through Kajabi and other third-party service providers.

Your use of Kajabi may also be subject to Kajabi’s own terms, privacy notices, and data practices.

Regulate™-related communication channels are for administrative, billing, and access-related questions only. They are not intended for personal health questions, crisis concerns, clinical updates, or requests for individualized guidance.

Access From Different Locations

Regulate™ may be accessible from different states, territories, or countries. Accessing the Product from any location does not mean that Studio AZK LLC or Anahita Kalianivala is providing psychological services, healthcare services, therapy, or professional treatment in that location.

You are responsible for determining whether your access and use of Regulate™ is appropriate and lawful in your location.

Changes to Product or Terms

We may update, revise, modify, or discontinue parts of Regulate™ at any time.

We may update these Terms from time to time. Updated Terms will apply to purchases made on or after their effective date. For existing purchasers, the Terms in effect at the time of purchase will continue to apply unless you separately agree to a change or a change is required by law.

Disclaimer of Warranties

Regulate™ is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Studio AZK LLC makes no warranties or representations, express or implied, regarding the Product, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted access, error-free operation, or suitability for your individual needs.

Limitation of Liability

To the fullest extent permitted by law, Studio AZK LLC, Anahita Kalianivala, and their representatives shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the purchase, access, or use of Regulate™.

To the extent permitted by law, total liability for any claim arising from or related to Regulate™ shall not exceed the amount paid for the Product.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded or restricted.

Indemnification

You agree to indemnify and hold harmless Studio AZK LLC, Anahita Kalianivala, and any affiliated parties from and against any claims, damages, losses, liabilities, costs, or expenses arising from your misuse of Regulate™, violation of these Terms, unauthorized sharing or distribution of the Content, or use of the Content in a way that was not intended.

Governing Law

These Terms shall be governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms, Regulate™, or your purchase or use of the Product shall be handled in accordance with applicable law.
